Terms of Service

1. Acceptance of Terms

By accessing or using Telebabe ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform.

2. Platform Description

Telebabe is an AI character creation, content generation, and monetization platform. The Platform provides tools for:

• Creating and configuring AI-powered characters
• Generating AI images and videos based on character configurations
• Managing content libraries and scheduling distribution
• Operating automated chatbots on Telegram and Instagram
• Processing payments from subscribers via multiple providers

The Platform acts solely as an infrastructure provider. Telebabe does not create, curate, or endorse any content generated by operators. All content decisions, subscriber interactions, and distribution choices are the sole responsibility of the operator who created the character.

3. User Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Provide a valid, verifiable identity
• Have the legal capacity to enter into a binding agreement in your jurisdiction
• Not be prohibited from using the Platform under applicable laws

The Platform reserves the right to request identity verification at any time. Failure to verify your identity may result in account suspension or termination.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not share your account with others or create multiple accounts.

5. Operator Responsibilities

As an operator (a user who creates and manages AI characters), you are solely responsible for:

• All content generated through your character configurations
• The prompts, settings, and parameters you use for content generation
• All interactions between your characters and subscribers
• Ensuring your content complies with applicable laws in your jurisdiction and your subscribers' jurisdictions
• Properly labeling AI-generated content as required by law
• Handling subscriber data in accordance with applicable privacy regulations

6. AI-Generated Content Disclaimer

All visual content generated through the Platform is entirely AI-generated. You acknowledge and agree that:

• AI-generated characters do not depict real persons and are entirely fictional
• AI content may contain artifacts, inaccuracies, or imperfections
• You are responsible for reviewing all generated content before distribution
• Generated content must comply with applicable laws regarding AI-generated media labeling and disclosure
• The Platform does not guarantee that generated content will be suitable for any particular purpose
• Any resemblance to real persons is coincidental and unintended

7. Prohibited Content and Conduct

You agree NOT to use the Platform to:

• Create deepfake content of real, identifiable individuals without their explicit written consent
• Generate, distribute, or store any content depicting or involving minors in any sexual, suggestive, or exploitative context
• Create non-consensual intimate imagery of any kind
• Produce content that promotes violence, harassment, hate speech, or discrimination
• Impersonate real public figures for deceptive or fraudulent purposes
• Distribute illegal content under any applicable jurisdiction
• Circumvent the Platform's safety measures or content policies
• Use the Platform for fraud, money laundering, or any other illegal activity
• Redistribute or resell Platform features without authorization

Violations of this section may result in immediate account termination, content removal, and referral to law enforcement where appropriate.

8. Payment Terms

8.1 Credits

The Platform operates on a credit-based system for content generation and certain premium features. Credits are purchased in advance and consumed upon use.

8.2 Subscriptions

Subscription plans auto-renew unless cancelled before the end of the billing period. We reserve the right to modify pricing with 30 days' prior notice.

8.3 Refund Policy

Used credits are non-refundable. Unused credit balances may be eligible for refund at the Platform's discretion within 14 days of purchase. Subscription fees are non-refundable once the billing period has begun.

8.4 Accepted Payment Methods

We accept payments via Stripe (credit/debit cards) and NOWPayments (cryptocurrency). All transactions are processed by third-party payment providers subject to their own terms.

9. Revenue Sharing

Operators earn revenue from subscriber payments to their characters. The Platform retains a configurable platform fee from each transaction. The fee percentage is disclosed to operators before they accept subscriber payments and may vary by plan.

Operator payouts are processed within 7 business days of the payout request, subject to minimum payout thresholds and successful identity verification. The Platform reserves the right to withhold payouts pending investigation of potential Terms violations.

10. Intellectual Property

10.1 Operator Content

Operators retain ownership of their character configurations, prompts, and the AI-generated content produced through the Platform, subject to the underlying AI model licenses. You grant Telebabe a non-exclusive, worldwide license to store, process, and deliver your content as part of the service.

10.2 Platform Infrastructure

Telebabe owns all rights in the Platform's software, user interface, branding, and infrastructure. Nothing in these Terms transfers any Platform intellectual property to you.

11. Data Handling

We collect and process personal data as described in our Privacy Policy. The Platform complies with GDPR and applicable data protection regulations. You may request a full data export at any time through the account settings or by contacting support.

12. Termination

12.1 By the Platform

We may suspend or terminate your account immediately and without prior notice for violations of these Terms, including but not limited to prohibited content, fraudulent activity, or non-payment. Upon termination for cause, any pending payouts may be forfeited.

12.2 By the Operator

You may delete your account at any time from your account settings. Upon voluntary deletion, your personal data and generated content will be retained for 30 days (for recovery purposes) and then permanently purged. You may request a data export before deletion.

13. DMCA and Takedowns

If you believe content on the Platform infringes your copyright or other rights, contact us at support@telebabe.xyz with a detailed DMCA notice. We will investigate and take appropriate action within 48 hours.

14. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of revenue, data, subscribers, or business opportunities
• We are not liable for content generated by operators or actions taken by subscribers
• Our total aggregate liability is limited to the amount you paid to the Platform in the 12 months preceding the claim

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation by contacting support@telebabe.xyz. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in accordance with applicable rules. Class action waivers apply to the maximum extent permitted by law.

16. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
